Prohibited Content and Publications
1. Purpose of This Section
This section specifies categories of content, materials, goods, and activities that are strictly prohibited from being created, published, promoted, transmitted, or otherwise processed through the Services operated by Permanent Systems LLC (Georgia).
This section supplements and forms an integral part of the Acceptable Use Policy and the Terms of Service.
2. General Prohibition
The Services may not be used to host, distribute, promote, facilitate, or otherwise process any content or activity that is unlawful, harmful, deceptive, or incompatible with the lawful operation of a multi-tenant software-as-a-service platform.
The Tenant is solely responsible for ensuring that all content and publications comply with these restrictions.
3. Prohibited Categories of Content
3.1 Weapons, Explosives, and Violence
Content related to:
- weapons, firearms, ammunition, explosives, or weapon components;
- instructions for manufacturing, modifying, or using weapons;
- promotion or facilitation of violent acts or threats of violence.
3.2 Drugs and Controlled Substances
Content related to:
- illegal drugs, narcotics, or controlled substances;
- drug paraphernalia or methods of drug production or distribution;
- promotion or facilitation of substance abuse.
3.3 Pornographic and Adult Content
Content related to:
- pornography or sexually explicit material;
- sexual services, escorting, or prostitution;
- adult-oriented goods or services where prohibited by law;
- sexual exploitation, abuse, or non-consensual material.
Content involving minors in any sexual context is strictly prohibited.
3.4 Gambling, Betting, and Games of Chance
Content related to:
- gambling, betting, lotteries, or games of chance;
- promotion of gambling services without required licenses or authorizations;
- facilitation of illegal or unregulated gambling activities.
3.5 Tobacco, Alcohol, and Regulated Consumer Products
Content related to:
- tobacco products, vaping devices, or related accessories;
- alcohol sales or promotion where restricted by law;
- products requiring age verification or regulatory approval, where such requirements are not met.
3.6 Medical, Pharmaceutical, and Health-Related Content
Content related to:
- medical services, pharmaceuticals, or health products offered without appropriate authorization;
- misleading or unverified medical claims;
- activities that may pose risks to health or safety.
3.7 Financial Services and Investments
Content related to:
- financial services, investments, securities, or insurance products offered without required licensing;
- high-risk investment schemes, pyramid schemes, or fraudulent financial activities;
- misleading financial representations or guarantees.
3.8 Intellectual Property and Counterfeit Goods
Content that:
- infringes copyrights, trademarks, patents, or other intellectual property rights;
- involves counterfeit, pirated, or unlawfully reproduced goods or materials;
- facilitates infringement of third-party rights.
3.9 Fraud, Deception, and Misrepresentation
Content or activities involving:
- scams, phishing, or social engineering;
- false or misleading representations;
- impersonation of individuals, companies, or organizations, including Permanent Systems LLC (Georgia).
3.10 Hate, Harassment, and Harmful Conduct
Content involving:
- hate speech, harassment, or discrimination;
- threats, intimidation, or coercion;
- exploitation of vulnerable individuals or groups.
4. No Exhaustive List
The categories listed above are not exhaustive.
Permanent Systems LLC (Georgia) reserves the right to determine, in its reasonable discretion, whether specific content or activities are prohibited under these Terms, even if not expressly listed.
5. No Monitoring Obligation
Permanent Systems LLC (Georgia) does not have an obligation to monitor, review, or moderate Tenant content.
The absence of enforcement action does not constitute approval or acceptance of any content or activity.
6. Enforcement and Consequences
Violation of this section constitutes a material breach of the Terms of Service.
Permanent Systems LLC (Georgia) may take enforcement measures, including:
- removal or restriction of content;
- suspension or termination of access to the Services;
- cooperation with law enforcement or regulatory authorities where required by law.
7. Relation to Other Terms
This section should be read together with:
- the Acceptable Use Policy;
- the Tenant Responsibilities section;
- the Enforcement Measures section;
- the Terms of Service as a whole.
In the event of a conflict, Permanent Systems LLC (Georgia) reserves the right to apply the strictest applicable interpretation.
