Overview

These Terms of Service (“Terms”) govern access to and use of the Services operated by Permanent Systems LLC (Georgia).

The Terms apply to all use of the Services by any Tenant and its authorized Users, and are intended to establish a clear legal framework for lawful use, responsibility allocation, and protection of the Services and other parties.

Capitalized terms used in these Terms have the meanings set out in the Definitions and Interpretation document, unless expressly stated otherwise.

1. Scope​

These Terms apply to all features, interfaces, APIs, and functionalities made available as part of the Services, including any updates, modifications, or replacements.

2. Parties and Responsibility Model​

  • Permanent Systems LLC (Georgia) provides and operates the Services.
  • Each Tenant uses the Services as an independent customer and is responsible for its own activities, configurations, and Users.
  • The Tenant is responsible for all use of the Services under its account, including actions performed by its Users.

3. Structure of the Terms​

These Terms are structured as a set of sections that together define rules of use, responsibilities, restrictions, enforcement measures, intellectual property protections, and termination rights.

Certain topics are governed by separate documents, including:

  • Privacy Policy and related privacy sections (personal data processing);
  • Data Processing Addendum (DPA), where applicable (controller/processor obligations);
  • payments, subscriptions, refunds, and chargebacks (covered in a separate payments section).

4. Precedence​

If multiple documents apply, the following order of precedence applies unless expressly stated otherwise:

  1. these Terms (including their sections);
  2. product-specific terms or written order terms, if any;
  3. the DPA, where applicable, for data processing obligations;
  4. privacy documentation for informational disclosures.

5. Updates​

Permanent Systems LLC (Georgia) may update these Terms from time to time. Updates become effective upon publication unless stated otherwise. Continued use of the Services after an update constitutes acceptance of the revised Terms.
