Enforcement Measures

1. Purpose of Enforcement Measures

This section describes the measures that Permanent Systems LLC (Georgia) may take in response to violations of the Terms of Service, including the Acceptable Use Policy and Prohibited Content restrictions.

These measures are intended to protect the Services, other tenants, data subjects, and third parties, and to ensure lawful operation of a multi-tenant software-as-a-service platform.


2. Discretionary Enforcement

Permanent Systems LLC (Georgia) may take enforcement action at its reasonable discretion where it determines that:

  • the Services are being used in violation of the Terms;
  • content or activities may expose the Services or third parties to legal, regulatory, or security risks;
  • continued use may harm the integrity, availability, or reputation of the Services.

Permanent Systems LLC (Georgia) is not required to provide prior notice before taking enforcement action where immediate action is necessary.


3. Types of Enforcement Measures

Enforcement measures may include, without limitation:

  • warnings or notices of non-compliance;
  • temporary restrictions on functionality or access;
  • removal, disabling, or restriction of content;
  • suspension of access to the Services;
  • termination of the Tenant account and associated access;
  • blocking of Users, integrations, or identifiers.

Measures may be applied progressively or immediately, depending on the nature and severity of the violation.


4. Suspension

Permanent Systems LLC (Georgia) may suspend access to the Services, in whole or in part, where:

  • a violation of the Terms is suspected or confirmed;
  • investigation of potential violations is required;
  • suspension is necessary to prevent harm or comply with legal obligations.

Suspension does not relieve the Tenant of its obligations under the Terms.


5. Termination

Permanent Systems LLC (Georgia) may terminate access to the Services where:

  • a material breach of the Terms has occurred;
  • repeated or severe violations are identified;
  • unlawful activities are conducted through the Services;
  • continued provision of the Services would pose legal or security risks.

Termination may be immediate in cases of serious violations.


6. Cooperation with Authorities

Where required by applicable law or lawful request, Permanent Systems LLC (Georgia) may cooperate with law enforcement, regulatory authorities, or courts.

Such cooperation may include disclosure of information to the extent legally required.


7. No Waiver

Failure or delay by Permanent Systems LLC (Georgia) to enforce any provision of the Terms does not constitute a waiver of its right to enforce such provision at a later time.


8. Limitation of Liability for Enforcement Actions

Enforcement actions are taken in good faith and based on available information.

Permanent Systems LLC (Georgia) shall not be liable for damages arising from enforcement actions taken in accordance with these Terms, to the extent permitted by applicable law.

  • the Tenant Responsibilities section;
  • the Suspension and Termination section;
  • the Terms of Service as a whole.
