Eligibility and Authority

1. Eligibility to Use the Services​

The Services are intended for use by legally capable individuals and entities acting in a professional or business capacity.

By accessing or using the Services, the user represents and warrants that they:

  • are at least the minimum legal age required to form a binding contract under applicable law; and
  • have full legal capacity to enter into these Terms.

2. Use on Behalf of an Entity​

Where the Services are used on behalf of a company, organization, or other legal entity, the individual accessing the Services represents and warrants that they have the authority to bind such entity to these Terms.

In such cases:

  • the entity is considered the Tenant; and
  • all obligations under these Terms apply to the entity.

Permanent Systems LLC (Georgia) may rely on this representation without independent verification.

3. Authorized Users​

A Tenant may authorize one or more individuals to access and use the Services under its account (“Users”).

The Tenant is responsible for:

  • defining access levels and permissions for its Users;
  • ensuring that Users comply with these Terms and all applicable laws;
  • all actions performed through the Tenant’s account, whether authorized or unauthorized.

4. Accurate and Current Information​

Tenants must provide accurate, complete, and up-to-date information when creating an account and throughout the use of the Services.

Permanent Systems LLC (Georgia) reserves the right to suspend or restrict access where information provided is materially inaccurate, misleading, or incomplete.

5. Restrictions on Eligibility​

The Services may not be used by:

  • individuals or entities prohibited from using similar services under applicable law;
  • individuals or entities subject to sanctions or restrictions where use of the Services would violate applicable law;
  • individuals acting without proper authority on behalf of a legal entity.

Permanent Systems LLC (Georgia) may restrict or deny access to the Services where required to comply with applicable legal or regulatory obligations.

6. No Obligation to Verify Eligibility​

Permanent Systems LLC (Georgia) is not obligated to verify the eligibility, authority, or legal status of any Tenant or User.

Responsibility for meeting eligibility requirements rests solely with the Tenant and its Users.

7. Consequences of Ineligibility​

If a Tenant or User does not meet the eligibility requirements set out in this section, Permanent Systems LLC (Georgia) may suspend or terminate access to the Services in accordance with these Terms.
