Lawful Use of the Services
1. General Requirement of Lawful Use
The Services may be used solely for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
The Tenant is responsible for ensuring that its use of the Services, including use by its Users, complies with all legal requirements applicable to the Tenant, its customers, and its activities.
2. Compliance with Applicable Laws
The Tenant must comply with all laws and regulations applicable to its use of the Services, including but not limited to:
- local, national, and international laws;
- laws applicable to electronic communications, advertising, and consumer protection;
- data protection and privacy laws, as addressed in the Privacy documentation and the DPA where applicable.
Permanent Systems LLC (Georgia) does not provide legal advice and does not assess the legality of the Tenant’s activities.
3. Cross-Border Use
The Services may be accessed and used from multiple jurisdictions.
The Tenant is solely responsible for ensuring that its use of the Services across jurisdictions is lawful, including compliance with:
- export control laws;
- sanctions or trade restrictions, where applicable;
- jurisdiction-specific regulatory requirements.
4. Compliance with Third-Party Rules
Where the Services integrate with or rely on third-party platforms, networks, or APIs, the Tenant is responsible for complying with all applicable terms, policies, and rules of such third parties.
Permanent Systems LLC (Georgia) is not responsible for enforcement of third-party rules and does not guarantee that the Services will prevent violations of such rules.
5. No Circumvention or Misuse
The Tenant may not use the Services to:
- circumvent legal requirements or regulatory obligations;
- conceal unlawful activities;
- misrepresent the nature or purpose of its activities;
- bypass technical safeguards, limits, or controls implemented within the Services.
6. Responsibility for Content and Activities
All content, communications, and activities conducted through the Services are the sole responsibility of the Tenant.
Permanent Systems LLC (Georgia) does not control, endorse, or assume responsibility for the legality of content or activities carried out by Tenants or their Users.
7. Consequences of Unlawful Use
Unlawful use of the Services constitutes a material breach of these Terms.
Permanent Systems LLC (Georgia) may take appropriate measures in response to unlawful use, including restriction, suspension, or termination of access to the Services, in accordance with these Terms and applicable law.
