Definitions and Interpretation

1. Purpose of This Document​

This document defines key terms and concepts used across the legal documentation of Permanent Systems LLC (Georgia).

The definitions set out herein apply to and are incorporated by reference into all related legal documents, including but not limited to the Privacy Policy, Data Processing Addendum (DPA), Terms of Service, and any product-specific terms, unless expressly stated otherwise.

2. Definitions​

For the purposes of the legal documentation, the following terms shall have the meanings set forth below.

Permanent Systems LLC (Georgia)​

A limited liability company incorporated under the laws of Georgia, acting as the provider and operator of the Services.

Services​

The multi-tenant software-as-a-service solutions operated by Permanent Systems LLC (Georgia), including:

  • Sotilink App, and
  • OnCast App,

as well as any other current or future applications, platforms, or services provided by Permanent Systems LLC (Georgia) that involve the processing of personal data.

Unless otherwise specified, references to the “Services” include all related functionalities, interfaces, APIs, and infrastructure.

Software-as-a-Service or SaaS​

A software delivery model in which applications are hosted and operated by the service provider and made available to customers over the internet, without transferring ownership of the software or underlying infrastructure to the customer.

Multi-Tenant or Multi-Tenant SaaS​

An architectural model in which multiple independent customers use a shared technical infrastructure while maintaining logical separation of data, configurations, and access controls.

Tenant​

A legal entity or individual that enters into an agreement with Permanent Systems LLC (Georgia) to use the Services and acts as an independent customer within the multi-tenant environment.

A Tenant may have multiple authorized users and may process personal data of its own customers, users, or contacts through the Services.

User​

An individual authorized by a Tenant or by Permanent Systems LLC (Georgia) to access and use the Services.

Personal Data​

Any information relating to an identified or identifiable natural person, as defined under applicable data protection laws.

Processing​

Any operation or set of operations performed on personal data, whether or not by automated means, including collection, storage, use, disclosure, or deletion.

Data Subject​

An identified or identifiable natural person to whom personal data relates.

Data Controller or Controller​

The entity that determines the purposes and means of the processing of personal data.

Within the Services, a Tenant typically acts as the Data Controller with respect to personal data of its customers or users.

Data Processor or Processor​

The entity that processes personal data on behalf of a Data Controller and in accordance with its instructions.

Within the Services, Permanent Systems LLC (Georgia) acts as a Data Processor with respect to tenant-controlled personal data.

Subprocessor​

A third party engaged by Permanent Systems LLC (Georgia) to process personal data on behalf of a Tenant as part of providing the Services.

Applicable Data Protection Laws​

All laws and regulations relating to the protection of personal data that apply to the processing activities described in the legal documentation, including but not limited to:

  • the General Data Protection Regulation (GDPR);
  • the Law of Georgia on Personal Data Protection;
  • other data protection laws applicable based on jurisdiction.

3. Interpretation​

Unless the context otherwise requires:

  • words in the singular include the plural and vice versa;
  • references to “including” or “include” shall mean “including without limitation”;
  • headings are for convenience only and do not affect interpretation.

4. Precedence​

In the event of any inconsistency between this document and any other legal document, this document shall govern the interpretation of defined terms, unless expressly stated otherwise.
